Las Vegas Resisting Arrest Attorney

If you or someone you know has been charged with resisting arrest in Nevada, the first question is usually whether it is a felony. In most cases, it is not. But there are situations where it is, and there are related charges that can raise the stakes quickly. This guide explains how Nevada’s resisting law works, when it becomes a felony, and what to do if it happens to you.

The Short Answer: Usually a Misdemeanor, With Two Felony Tiers

Nevada’s resisting law is NRS 199.280, titled “Resisting public officer.” Under the statute, resisting is usually a misdemeanor. It becomes a felony only when a weapon is involved:

• Category C felony: a firearm is used, or the person takes or tries to take a firearm from the officer. This carries 1 to 5 years in prison and a fine of up to $10,000.
• Category D felony: a dangerous weapon other than a firearm is used, or the person takes or tries to take such a weapon from the officer. This carries 1 to 4 years in prison and a fine of up to $5,000.
• Misdemeanor: no dangerous weapon is involved. This carries up to six months in jail, a fine of up to $1,000, or both.

You can read the full text in Chapter 199 of the Nevada Revised Statutes. If the statute’s felony tiers don’t describe what happened, the resisting count on its own is a misdemeanor. That is not the end of the story, though, because the felony risk often comes from somewhere else.

The Law Is Broader Than a Struggle

Most people picture resisting arrest as a physical fight with an officer. The statute is wider than that. It covers anyone who willfully resists, delays, or obstructs a public officer who is carrying out, or trying to carry out, a legal duty. Three details matter:

• It does not require an arrest. Delaying or obstructing an officer during a detention or investigation can fall under the same law.
• It requires willful conduct. A reflex, an accident, or a movement caused by pain is different from deliberately fighting or fleeing.
• It requires a legal duty. The statute protects officers doing lawful work, which is one reason the legality of the stop or arrest can matter in court.

Picture a man stopped outside a casino on Fremont Street. An officer grabs his wrist to handcuff him, and he flinches and pulls his arm back. To him, it was a reflex. In a police report, it can read as “pulled away and refused to be handcuffed.” Whether that was willful resistance is a question of fact, and it is often where these cases are won or lost.

The Charge That Travels With It: Battery on an Officer

When resisting arrest becomes a serious problem, it is usually because of an added charge. The most common is battery on an officer, which is a separate offense under NRS 200.481. Battery is any willful use of force or violence against another person, and Nevada penalizes it more harshly when the victim is an officer performing a duty.

• If the officer is not seriously hurt, battery on an officer is generally a gross misdemeanor.
• If the officer suffers substantial bodily harm, the battery involves strangulation, or a deadly weapon is used, it becomes a category B felony. For the substantial bodily harm and strangulation tier, the prison range is 2 to 15 years.

The law also looks at whether the person knew, or should have known, that the other person was an officer. In a fast, chaotic arrest, that can be a real factual dispute. The resisting count may be the misdemeanor, but the battery count is the one that threatens prison time.

If you are facing a battery or other violent charge connected to an arrest, speaking early with a Las Vegas violent crimes defense lawyer is one of the most useful things you can do.

What to Do During an Arrest

The safest approach is simple: comply in the moment, challenge it in court. If an arrest is unlawful, the courtroom is where that gets decided. The street is not, and physical resistance can lead to injuries and new charges, even when the original stop was questionable.

• Stay calm and keep your hands where officers can see them.
• Do not run, pull away, or push against the officer, even if you think the arrest is wrong.
• Do not argue about whether the arrest is lawful. You can calmly say that you would like to speak with a lawyer.
• Do not explain what happened. What you say can be used in the case, and the same is true of what you say later from jail. Our guide on what not to say on a jail phone call in Nevada covers that part.

What to Do Afterward

Once you are out of custody, the details of the encounter matter, and memories fade quickly. If you can, do the following as soon as possible:

• Write down everything you remember: where it happened, what each officer said and did, and the order of events.
• Note the names or descriptions of any witnesses, and any businesses nearby that may have surveillance cameras.
• Photograph any injuries, including marks from handcuffs.
• Avoid posting about the incident or discussing it with anyone other than your attorney. Our article on common mistakes to avoid after an arrest in Nevada explains what else to watch out for.

If you are not a U.S. citizen, tell your attorney before you resolve any charge. The immigration consequences of a conviction can differ from the criminal ones, so that conversation needs to happen first.

How These Charges Are Challenged

Every case turns on its own facts, but a few questions come up often when a resisting charge is reviewed:

• Was the conduct willful? A flinch, a stumble, or a reaction to pain may not meet the statute.
• Was the officer performing a legal duty? If the stop or arrest was not lawful, that can matter.
• What does the video show? Body camera and surveillance footage can confirm or contradict a police report.
• Are the reports consistent? Differences between officers’ accounts, or between a report and the recording, can affect how strong the case is.

A resisting count can also be part of how the whole case is negotiated, especially when other charges came from the same incident. If you are heading to your first hearing, our guide on how to prepare for your first court appearance in Nevada explains what to expect.

The Bottom Line

In Nevada, resisting arrest is usually a misdemeanor, but a weapon turns it into a felony, and a battery charge added to the case can carry far more risk than the resisting count itself. If you have been charged, what you do in the next few days matters, so write down what happened, avoid discussing it, and talk to a lawyer.

Frequently Asked Questions

Is resisting arrest a felony or a misdemeanor in Nevada?

It is usually a misdemeanor. It becomes a felony only when a dangerous weapon is used, or when the person takes or tries to take a weapon from the officer. A firearm makes it a category C felony, and any other dangerous weapon makes it a category D felony.

What is the penalty for resisting arrest in Nevada?

A misdemeanor carries up to six months in jail, a fine of up to $1,000, or both. A category D felony carries 1 to 4 years in prison and up to a $5,000 fine. A category C felony carries 1 to 5 years in prison and up to a $10,000 fine.

Can you be charged with resisting arrest if you never touched the officer?

Yes. The statute covers willfully resisting, delaying, or obstructing an officer in the performance of their legal duties. Conduct such as running, pulling away, or interfering with an officer can be charged under it, whether or not there was physical contact.

Is resisting arrest the same as battery on an officer?

No. They are separate charges under different statutes. A person can be charged with both in the same incident, and the battery charge is usually more serious.

Can you legally resist an unlawful arrest in Nevada?

The resisting statute applies to an officer’s legal duties, so whether an arrest was lawful can matter in court. But physically resisting in the moment is risky and can lead to injury and new charges. The safer path is to comply and challenge the arrest through an attorney.

Can a resisting arrest charge be dropped or reduced?

It depends on the facts, the video evidence, and any other charges from the same incident. An attorney can review the reports and recordings and explain what options may be available in your case.
